Please read these Terms and Conditions ("Terms") carefully before using echasfoundation.org or joining the Creative Parents Community (the "Community").

By accessing our Website or joining our Community, you agree to be bound by these Terms. If you do not agree, please do not use our Website or Community.

1. WHO WE ARE

This Website and Community is owned and operated by Molly Arbuthnott, a sole trader based in Scotland, United Kingdom.

2. THE COMMUNITY

The Creative Parents Community is a paid membership community designed for parents, educators, and caregivers who want to understand children's creative expression. Membership provides access to:

  • Community discussions and parent network
  • Molly's insights and weekly content
  • The Question Vault and resource library
  • Monthly live conversations
  • The 7-Day Creative Journey program
  • Any additional resources made available during membership

The content and structure of the Community may evolve over time. We reserve the right to update, modify, or replace any element of the Community without notice, provided the core value of membership is maintained.

3. MEMBERSHIP AND PAYMENT

Joining:
Your first month costs £1, donated directly to Tiny Tickers (UK Charity No. 1155135). After your first month, membership continues at £17.60 per month unless cancelled.

Billing:
Payments are processed automatically each month using the payment method provided at signup. You authorize us to charge your payment method on a recurring monthly basis.

Cancellation:
You may cancel your membership at any time by emailing hello@echasfoundation.org. Cancellation takes effect at the end of your current billing period. You will retain access to the Community until your billing period ends.

Price Changes:
We reserve the right to change our membership price. We will provide at least 30 days' notice of any price changes by email. Continued membership after the notice period constitutes acceptance of the new price.

4. REFUND POLICY

Please see our separate Refund Policy below for full details.

5. YOUR ACCOUNT

You are responsible for maintaining the confidentiality of your account login details. You must not share your account with others. If you believe your account has been compromised, contact us immediately at hello@echasfoundation.org.

Membership is personal and non-transferable. You may not purchase membership on behalf of another person without their explicit consent.

6. ACCEPTABLE USE

By joining our Community, you agree to:

  • Treat all members with kindness and respect
  • Not share, copy, or distribute any Community content without our written permission
  • Not post offensive, defamatory, harmful, or illegal content
  • Not impersonate any person or misrepresent your identity
  • Not use the Community for commercial purposes or to promote your own products or services without our consent

We reserve the right to remove any member from the Community, without refund, if their conduct violates these standards or disrupts the experience of other members.

7. INTELLECTUAL PROPERTY

All content on this Website and within the Community, including guides, frameworks, programs, artwork, text, and resources, is the intellectual property of Molly Arbuthnott and is protected by UK and international copyright law.

Your membership grants you a limited, personal, non-transferable, non-commercial license to access and use Community content for your own personal use only.

You may not copy, reproduce, distribute, sell, or share any Community content without our express written permission.

Content you share within the Community (such as your child's artwork or personal comments) remains your property. By sharing it, you grant us permission to use it for Community purposes (e.g., sharing in discussions) but we will never use it commercially without your consent.

8. DISCLAIMERS

Our Community provides educational and observational content about childhood creativity. It is not a substitute for professional psychological, medical, or therapeutic advice.

We make no guarantees about specific outcomes or results from membership. Every child and family is different, and individual experiences will vary.

Our Website and Community are provided "as is" without warranties of any kind. We make reasonable efforts to ensure content is accurate and up to date but cannot guarantee this at all times.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by UK law, Molly Arbuthnott shall not be liable for any indirect, incidental, or consequential loss or damage arising from your use of our Website or Community.

Our total liability to you shall not exceed the total amount you have paid us in the 3 months preceding any claim.

10. GOVERNING LAW

These Terms are governed by the laws of Scotland and the United Kingdom. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.

11. CHANGES TO THESE TERMS

We reserve the right to update these Terms at any time. We will notify you of significant changes by email. Continued use of our Website or Community after changes constitutes acceptance of the updated Terms.
